Northwest Arkansas Journalists Sue FBI Over Denial of FOIA Request
Doug and Lisa Thompson, journalists from the Northwest Arkansas Democrat-Gazette, have filed a lawsuit against the Federal Bureau of Investigation (FBI) over its refusal to supply documents requested under the Freedom of Information Act (FOIA). The documents in question pertain to a former FBI special agent, Robert Cessario, who pleaded guilty to erasing the hard drive of his computer in 2017. This action was in defiance of a court order requiring him to surrender the computer for forensic examination. Cessario had obtained recordings from a cooperating defendant, which he placed on his government-issue computer, only to delete them after questions arose about the recordings.
FBI’s Initial Response and Subsequent Delays
When Doug Thompson initially filed the FOIA request in August 2022, the FBI responded that while the records existed, they were exempt from disclosure due to privacy concerns. After an administrative appeal, the FBI informed Thompson that they had found 3,783 pages of potentially responsive records, but processing them would take a significant 67 months. Thompson was given the option to reduce the scope of his request, further delaying the process. The FBI’s responses and prolonged processing times have led the journalists to contend that the agency is violating FOIA by not making a timely determination and release of the requested documents.
